Terms of Service

These Terms of Service ("Terms") govern your use of the Wattora application ("the app", "we", "us") for iOS and macOS. By downloading, installing, or using Wattora, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Description of Service

Wattora displays day-ahead wholesale electricity prices for selected European markets (Italy, Greece, Czechia, Romania, and Slovenia). Price data is sourced from the ENTSO-E Transparency Platform, a publicly available EU data source.

2. Eligibility

You must be at least 16 years of age to use Wattora. By using the app, you represent that you meet this requirement.

3. User Accounts

Wattora does not require you to create an account. No personal identity information (name, email, phone number) is collected. Your preferences and subscription status are managed through your device and Apple ID.

4. Free and Premium Tiers

• Free tier — access to current-day electricity prices with advertisements served by Google AdMob.
• Premium subscription — $2.99/month or $24.99/year. Premium features include push notifications for price alerts, 7-day price history, home screen widgets, and an ad-free experience.

5. Subscriptions and Payments

• All payments are processed by Apple through the App Store. We do not collect or store any payment information.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• You can manage or cancel your subscription at any time through your Apple ID settings: Settings > [Your Name] > Subscriptions.
• Refunds are handled by Apple in accordance with their App Store terms.
• Prices may change. We will provide advance notice of any price changes through the app. Price changes take effect at the start of the next billing period following the notice.

6. Data Accuracy Disclaimer

Electricity prices displayed in Wattora are provided for informational purposes only.

• Prices are sourced from the ENTSO-E Transparency Platform and may be delayed by up to 1 hour.
• We make reasonable efforts to ensure accuracy but do not guarantee that prices are error-free, complete, or current at all times.
• Discrepancies may occur due to data source delays, network issues, or processing errors.
• You should verify prices with official sources before making any decisions based on the data shown in Wattora.

7. No Financial Advice

Wattora does not provide financial, investment, energy trading, or any other form of professional advice. The app displays publicly available market data for informational purposes only. Any decisions you make based on information from Wattora are made at your own risk. We are not responsible for any financial loss or damages resulting from your use of or reliance on the data displayed in the app.

8. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the app.
• Use automated systems (bots, scrapers) to extract data from the app or its backend services.
• Attempt to gain unauthorized access to our servers or infrastructure.
• Use the app for any unlawful purpose.
• Redistribute or resell the data obtained through the app.

9. Intellectual Property

All content, design, code, and trademarks in Wattora are owned by us or our licensors. The ENTSO-E data is used in accordance with the ENTSO-E Transparency Platform terms. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

10. Service Availability

We strive to keep Wattora available at all times but do not guarantee uninterrupted service. The app may be temporarily unavailable due to:

• Scheduled or unscheduled maintenance.
• ENTSO-E data source outages or delays.
• Network or infrastructure issues.
• Force majeure events.

We reserve the right to modify, suspend, or discontinue the app (or any part of it) at any time, with or without notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Wattora is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app.
• Our total aggregate liability for any claims arising from your use of the app shall not exceed the amount you paid for the app in the 12 months preceding the claim.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the app.

13. Third-Party Services

Wattora integrates with third-party services (Google AdMob, Apple StoreKit, ENTSO-E). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app. Your continued use of Wattora after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the app.

15. Termination

We may terminate or suspend your access to Wattora at any time if you violate these Terms. Upon termination, your right to use the app ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Italian Republic and applicable European Union regulations. Any disputes arising from these Terms or your use of Wattora shall be subject to the exclusive jurisdiction of the courts of Milan, Italy.

If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection legislation.

17. Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We encourage you to contact us first at [email protected] to resolve any issues before initiating formal proceedings.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wattora regarding your use of the app.
